TERMS & CONDITIONS

These are the Terms and Conditions upon which Crow Cams Australia Pty Ltd ACN 160 053 832 (“Company”) sells and quotes for the supply of Goods to another party (“Customer”).

1. DEFINITIONS & INTERPRETATION

• ‘Company’ means Crow Cams Australia Pty Ltd ACN 160 053 832, being a wholesale retailer and manufacturer of automotive parts.
• ‘Conditions’ means the terms and conditions of sale and service as set out in this document any special conditions agreed in writing by the Company.
• ‘Customer’ means the party, person, firm, agent or corporation from whom an order is accepted by the Company for the supply of Goods, to whom a quote is provided for the supply of Goods, or whom is browsing the Website.
• ‘Goods’ shall mean the products, materials, equipment and/or services supplied by the Company.
• ‘Terms and Conditions of Sale’ means this document.
• ‘Third Party Product’ means any product supplied by the Company to the Customer which is not manufactured by the Company and which has its own manufacturer’s warranty.
• ‘Warranty Policy’ means the document and/or details which set out the Company’s warranty conditions, in addition to any other rights and remedies available to the Customer under Australian law.
• ‘Website’ means the website with the URL crowcams.com.au, being the ecommerce website owned by the Company where a Customer can browse, select and order products advertised on the Website and which are available by the Company.
• In the context of the Website, and these Terms and Conditions, the terms “we”, “our” and “us” means the Company and “you” and “your” means the Customer.

 

2. GENERAL

• Unless expressly stated otherwise, words purporting the singular shall be deemed to include the plural.
• The use of the term “product” includes the plural “products”.
• Unless expressly stated otherwise, the following Terms and Conditions, together with the Privacy Statement and Policy, govern your use of the Website and/or the purchase of Goods from the Company. The following Terms and Conditions, and the Privacy Statement and Policy, describe the rights and responsibilities of both you and the Company. By using the Website or purchasing Goods from the Conditions, you agree to be bound by these Terms and Conditions.
• These terms and conditions together with your order constitute the entire contract between you and the Company for the supply of Goods. No other terms will apply except where terms may be implied by law. The contract cannot be varied unless we agree to vary it in writing.
• The information on this site is governed by Australian law.
• We reserve the right to change the Terms and Conditions on our own volition.

 

3. CHANGES TO PRODUCTS AND VISUAL REPRESENATIONS

• The Company may make changes to the description of Goods and to the content of the Website at any time and without prior notice.

• We make every effort to ensure that product descriptions for Goods advertised on our Website are accurate, however there is no guarantee that inaccuracies, such as typographical errors or misinterpretations, may occur from time to time.

• We reserve the right to correct any such inaccuracy as and when they are identified.

• All visual representations contained within the Website, or in any catalogue owned or produced by the Company, are for illustration purposes only.

 

4. PRODUCT PRICES

• The price displayed for Goods on the Website, or in any catalogue owned or produced by the Company, represents the full price, including GST, for the Goods, but excludes any delivery charges which may be applicable to the supply of the Goods to the Customer and which are subject to the shipping destination.
• We always seek to provide Goods at the most competitive prices, and reserve the right to change prices displayed for Goods on our website, or in any catalogue owned or produced by the Company, at any time and without prior notice.
• All of our prices are in Australian dollars (AUD).

 

5. AGE RESTRICTIONS

• You must be at least eighteen (18) years of age to place an order with us. We do not knowingly accept orders from anyone under 18.
• By placing an order with us you acknowledge that you are over eighteen (18) years of age.
• Should we suffer any loss or damage as a result of a transaction entered into by a person under the age of 18, we reserve the right to seek compensation for such loss or damage from the parents or guardians of the person who placed the order(s) with us.

 

6. INTERNET COMMUNICATIONS & USE OF WEBSITE

• By using the Website, you consent to receiving communications electronically via email.
• The nature of Internet communications means that communications may be susceptible to data corruption, interception and delay, which the Company are not responsible for.
• When you visit the Website, the Website may automatically send you a “cookie”. A cookie is a piece of text from a web server to your computer, sent over the internet, and is used to identify you. This information does not personally identify you, but it may tell us that the computer which you are using has visited our Website and what areas of the Website you have browsed. You may decline cookies by adjusting the setting of your browser, however, this may affect the functionality and accessibility of the Website.

• Material contained on the Website may be protected by copyright. You may use the Website for personal and non-commercial purposes.

• The Website, and the products, technology and processes contained in the Website, may be the subject of other intellectual property rights owned by the Company and/or third parties. You agree, that no license is granted to you, in respect of those intellectual property rights.

 

8. ORDERING GOODS

• When you place an order with us, you have made an offer to purchase the product that you have chosen. When we take payment, we have accepted your offer.
• Both the offer and acceptance are based on these terms and conditions.
• We may notify you when we process your order by sending you an order confirmation. The order confirmation may be sent via email. In order to prevent credit card or payment fraud your offer can only be accepted by us after it has passed our validation procedures.
• We retain discretion to cancel orders if our processes identify any attempt at fraud or for any other legitimate reason.
• If for any reason we cannot process or accept your order after payment is receive, we will contact you by email or telephone to determine your requirements for the reimbursement of monies paid.
• When purchasing from us, you agree to provide an accurate email address, delivery address, billing address, and telephone number, and agree that you will ensure those details remain current and contactable.
• The provision of incorrect information by you may lead to a delay in delivering Goods ordered by you and/or non-delivery. The Company is not liable for such delays or non-deliveries.

 

9. INTERNATIONAL ORDERS

• We do not accept international orders through the Website.

• To order Goods for shipment outside of Australia, please contact our office via phone or email.

• For international customers, our preferred carriers are FEDEX and DHL.

• Please note that our delivery and freight charges will not include any taxes and duties imposed by your local government or any other non-Australian regulatory authority. You will be liable for these amounts. These amounts may be paid, in advance, by FEDEX or DHL, and you will be liable to reimburse them, for such payments.

 

10. PAYMENT

• We only accept payment through Electronic Funds Transfer, PayPal, and credit cards (namely, Visa or Mastercard).

• Payment will not be processed until we have received all relevant information required for processing to be completed.

• For payments made via credit cards:

1. We accept Australian credit cards only.
2. We process credit card payments when you checkout from the product order screen.
3. We will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a Customer whose credit card is fraudulently used or is used in an unauthorised manner.

 

11. SECURITY POLICY

• When purchasing from the Company, your financial details are passed through a secure server using the latest encryption technology.

 

12. SHIPPING PRACTICES AND DELIVERY POLICY

• Goods purchased are shipped from our warehouse located in Knoxfield, Victoria. Our delivery partners are Startrack, Courier Please, DHL & Fedex.
• If, for any reason, your order, or part thereof, cannot be shipped you will be notified promptly.
• Orders are typically dispatched within two business days, from the date that payment has been received in full, and delivery time will vary depending on your location and third-party couriers.
• All parcels upon delivery will need to be signed for.  If you are not available, when our delivery partner attempts a delivery, a card may be left advising you that your order will be available for you to collect from your local post office. If no such arrangements can be made, we, or our delivery partner, will attempt to contact you to arrange an alternative delivery time.
• Please note that shipping and handling rates are calculated based upon your location and the size/weight of your order.
• The Company is not liable for any delays in delivery caused by third parties, including any industrial action.
